OurCal Terms and Conditions

Last updated: 31/08/2026

1. Acceptance of Terms

By accessing or using OurCal (the "Service"), operated by [OurCal Pty Ltd / your legal entity name] ("OurCal," "we," "us," or "our"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the Service.

OurCal is operated from Australia. If you are using the Service on behalf of an organisation (a "Host"), you represent that you have the authority to bind that organisation to these Terms.

2. Description of Service

OurCal is a follow-only events calendar platform. Hosts may create profiles and publish events, which Users may follow to see in a combined feed. OurCal does not provide ticketing, payment processing for event attendance, or facilitate transactions between Hosts and Users for event access. Any external links, sign-ups, or payments related to an event occur entirely outside the Service and are the sole responsibility of the Host and User involved.

3. Geographic Availability

3.1 OurCal is currently available to Users and Hosts located in select countries only. It is not currently available to residents of the European Union, the United Kingdom, or the European Economic Area (Iceland, Liechtenstein, and Norway), while we build out compliance with the data protection laws applicable in those regions.

3.2 We may update the list of available countries from time to time. Attempting to create an account from an unsupported country, including by misrepresenting your location, is a breach of these Terms.

3.3 Existing accounts are not affected by later changes to the list of available countries.

4. Eligibility and Accounts

4.1 You must be at least 16 years of age to create an account. If you are under 18, you confirm you have the consent of a parent or guardian.

4.2 At sign-up, you will be asked to provide your country. This is used to determine eligibility under Section 3, and to apply the correct default timezone and currency display.

4.3 You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

4.4 You agree to provide accurate information when creating an account and to keep it up to date.

4.5 OurCal reserves the right to suspend or terminate accounts that violate these Terms, provide false information (including false country information), or are inactive for an extended period, at our discretion.

5. Public and Private Calendars — Important Visibility Notice

5.1 Public calendars and events are visible to anyone, including people who do not follow the Host and are not registered Users of the Service. Public content may be indexed by search engines, shared externally, or viewed by the general public. Hosts should not treat "public" as meaning "only visible to my followers."

5.2 Private calendars and events are visible only to Users who have been granted access via an invite link or code issued by the Host. Hosts are solely responsible for managing who they share private invite links with. OurCal is not responsible for private content that becomes accessible because a Host shared an invite link publicly or with an unintended recipient.

5.3 Hosts are solely responsible for selecting the correct visibility setting (public or private) for each calendar and event, and for understanding the consequences of that setting before publishing.

6. Event Times and Timezones

6.1 Every event is published with an explicit timezone set by the Host. Hosts are responsible for ensuring the timezone attached to their event is correct.

6.2 Times shown to Users may be displayed in the Host's stated timezone, the User's local timezone, or both, depending on the Service's display settings at the time. OurCal is not responsible for a User missing an event due to timezone confusion where the Host has correctly set the event's timezone.

7. Prohibited Uses

You agree not to use the Service to create, publish, promote, or link to events, profiles, or content that:

7.1 Are illegal under Australian law or the law of the jurisdiction in which the Host or User is located;

7.2 Relate to the sex trade, commercial sexual services, escort services, or adult/sexual content of any kind, regardless of legality in a given jurisdiction;

7.3 Promote or facilitate the sale of illegal drugs, weapons, or other prohibited goods;

7.4 Involve hate speech, harassment, discrimination, or incitement to violence;

7.5 Are fraudulent, deceptive, or intended to scam or mislead Users;

7.6 Infringe the intellectual property, privacy, or other rights of any third party;

7.7 Involve unauthorised ticketing, resale, or payment collection through means that circumvent these Terms;

7.8 Impersonate any person or organisation, or misrepresent your affiliation with any person or organisation;

7.9 Introduce viruses, malware, or otherwise attempt to interfere with the proper functioning of the Service.

OurCal reserves the right to remove any content and suspend or terminate any account that violates this section, at our sole discretion and without prior notice.

8. User-Generated Content and Sensitive Data

8.1 Hosts are solely responsible for the content of the events, profiles, and other material they publish on the Service ("Host Content").

8.2 Hosts must not include sensitive personal information in any event, calendar, or public-facing content, including but not limited to: health or medical information, financial or payment details, government identification numbers, information revealing a person's racial or ethnic origin, religious beliefs, sexual orientation, or criminal history, or any other information that could reasonably be considered sensitive personal data under the Privacy Act 1988 (Cth) or equivalent legislation.

8.3 Hosts must not include personal information about individuals (e.g. names, phone numbers, addresses) in event descriptions without that individual's consent, particularly on Public calendars.

8.4 By publishing Host Content, you grant OurCal a non-exclusive, worldwide, royalty-free licence to host, display, distribute, and reproduce that content solely for the purpose of operating and promoting the Service (including embeds, generated posters, and shared previews).

8.5 OurCal does not review or moderate all content before publication and is not responsible for the accuracy, legality, or appropriateness of Host Content, though we reserve the right to remove content that violates these Terms.

9. Subscriptions and Payment

9.1 OurCal offers a Free tier and a Premium subscription tier, as described on our Pricing page. Pricing may be displayed in your local currency for convenience.

9.2 Premium subscriptions are billed monthly or annually via our third-party payment processor (Stripe). By subscribing, you authorise recurring charges until you cancel.

9.3 Subscription fees are non-refundable except as required by the Australian Consumer Law or at OurCal's discretion.

9.4 We reserve the right to change subscription pricing with reasonable notice to existing subscribers before the change takes effect.

9.5 Failure to pay may result in automatic downgrade to the Free tier and loss of access to Premium features.

10. Intellectual Property

10.1 The Service, including its design, branding, and underlying software, is the property of OurCal and protected by intellectual property laws. These Terms do not grant you any rights to OurCal's trademarks, logos, or branding except as expressly permitted (e.g. embed widgets).

10.2 Hosts retain ownership of their own logos, branding, and content uploaded to the Service.

11. Third-Party Services and Links

The Service may allow Hosts to link to external websites, sign-up forms, or payment pages, and may integrate with third-party calendar applications (Google, Apple, Outlook) and payment processors (Stripe). OurCal is not responsible for the content, policies, or practices of any third-party service linked from or integrated with the Service.

12. Disclaimers

12.1 The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

12.2 OurCal does not guarantee the accuracy, completeness, or timeliness of any event information published by Hosts. Users rely on Host Content at their own risk.

12.3 OurCal is not responsible for any event cancellations, changes, or the conduct of any Host or attendee at any event listed on the Service.

13. Limitation of Liability

To the maximum extent permitted by law, OurCal, its directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill arising from your use of, or inability to use, the Service — even where OurCal has been advised of the possibility of such damages. Nothing in these Terms excludes any guarantee, right, or remedy that cannot lawfully be excluded under the Australian Consumer Law.

14. Indemnity

You agree to indemnify and hold OurCal harmless from any claims, losses, liabilities, damages, and expenses (including legal fees) arising from your use of the Service, your Host Content, or your breach of these Terms.

15. Termination

15.1 You may stop using the Service and delete your account at any time via account settings.

15.2 OurCal may suspend or terminate your account, with or without notice, for violation of these Terms or for any reason at our discretion, particularly where continued access would pose a legal, safety, or reputational risk to OurCal or its Users.

15.3 Upon termination, your right to use the Service ceases immediately. Provisions of these Terms which by their nature should survive termination (including Sections 3, 8, 10, 12, 13, and 14) will survive.

16. Privacy

Our collection and use of personal information is governed by our [Privacy Policy], which forms part of these Terms. By using the Service, you consent to the collection and use of information as described there.

17. Changes to These Terms

We may update these Terms from time to time. Material changes will be notified via the Service or by email where practicable. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

18. Governing Law

These Terms are governed by the laws of Victoria, Australia. Any disputes arising from these Terms or the Service will be subject to the exclusive jurisdiction of the courts of Victoria, Australia.
